Allegation

It is alleged that the Member engaged in professional misconduct pursuant to s. 51(1)(c) of the Code, as set out in one or more of the following paragraphs of section 1 of Ontario Regulation 854/93: a. He contravened by act or omission the Act, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts, namely s. 82(1) of the Code and s. 10, 11 and/or 13 of the General Regulation (paragraph 33); b. He failed to reply appropriately in writing within thirty days to any written communication from the College that requests a response (paragraph 44); and/or c. He engaged in conduct or performed an act, relevant to the practice of denturism that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable unethical or unprofessional (paragraph 47). In addition, it is alleged that the Member engaged in professional misconduct pursuant to s. 51(b.0.1) of the Code as he failed to co-operate with the Quality Assurance Committee.

Allegation

He failed to abide by any term, condition or limitation imposed on the member’s certificate of registration (paragraph 1); b. He contravened by act or omission the Act, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts, namely s. 82(1) of the Code and s.10, 11 and/or 13 of the General Regulation (paragraph 33); c. He failed to attend an oral caution of the Complaints Committee or an oral reprimand of the Discipline Committee (paragraph 39); d. He failed to reply appropriately in writing within thirty days to any written communication from the College that requests a response (paragraph 44); and/or e. He engaged in conduct or performed an act, relevant to the practice of denturism that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable unethical or unprofessional (paragraph 47). In addition, it is alleged that the Member engaged in professional misconduct pursuant to s. 51(b.0.1) of the Code as he failed to co-operate with the Quality Assurance Committee.

Notation of the Fact
As a result of its investigation of a Registrar’s Report, a Panel of the Inquiries, Complaints and Reports Committee decided to caution Mr. Zaur Agivaev.

Summary of the Caution
The Panel cautions Mr. Agivaev regarding his responsibility pursuant to the Regulated Health Professions Act, 1991 mandate that denturists registered with the College participate in a Quality Assurance Program which includes participation in Continuing Professional Development activities. The panel also cautions Mr. Agivaev for failing to respond appropriately in writing within thirty (30) days to written communication from the College that requested a response.
