According to the Order of the Discipline Committee of the College dated May 21, 2020, Mr. Agivaev must: 1) comply with the outstanding and ongoing terms, conditions and limitations on his Certificate of Registration, as contained in the order of the Discipline Committee of the College dated April 23, 2019, including that the Member must unconditionally pass the PROBE course in ethics; 2) successfully complete, to the satisfaction of the Registrar and at his own expense, a pre-approved ethics course, within four (4) months of the date of this Order; 3) successfully complete, at his own expense, the College’s Jurisprudence Program, within two (2) months of the date of this Order; 4) attend one (1) meeting, at his own expense, with a regulatory expert, approved by the Registrar, to review the Member’s past issues of non-compliance, within four (4) months of the date of this Order; 5) successfully complete, to the satisfaction of the Registrar, an essay to the Registrar setting out what the Member has learned from the investigation, hearing, ethics course, jurisprudence course and meeting with the regulatory expert, within six (6) months of the date of this Order; 6) respond to all College communication within fifteen days of delivery (deemed or otherwise); and 7) advise the College of any change to any contact information within fifteen days of the date of change.

c. He engaged in conduct or performed an act, relevant to the practice of denturism that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable unethical or unprofessional (paragraph 47).
In addition, it is alleged that the Member engaged in professional misconduct pursuant to s. 51(b.0.1) of the Code as he failed to co-operate with the Quality Assurance Committee.

Decision and ReasonsOn April 23, 2019, a panel of the Discipline Committee found that Mr. Agivaev to have engaged in professional misconduct as set out in the Notice of Hearing and as admitted in the Agreed Statement of Facts: 1. he failed to comply with the Quality Assurance Program, 2. He failed to attend an Oral Caution ordered by the ICRC and, 3. He failed to update the College as to the address of his primary residence and his current phone number. The Agreed Statement of Facts confirmed for the panel that the allegations found therein constituted Professional Misconduct and the panel was satisfied that the misconduct would reasonably be considered by members of the profession to be unethical or unprofessional.
Order: The Discipline Committee ordered the following sanctions: 1. Mr. Agivaev is required to appear before the panel to be reprimanded immediately following the hearing. 2. The Registrar is directed to suspend Mr. Agivaev’s certificate of registration for a period of four (4) months, on a date to be selected by the Registrar, of which three (3) months shall be suspended if Mr. Agivaev completes the terms, conditions and limitations set out in paragraphs 3(a) and 3(b) of the Order within three (3) months of the date of this order. 3. The Registrar is directed to immediately impose the following specified terms, conditions and limitations on Mr. Agivaev’s certificate of registration requiring that Mr. Agivaev successfully complete, at his own expense, the outstanding QA requirements, within four months of the date of this order; requiring that Mr. Agivaev unconditionally pass, at his own expense, to the satisfaction of the Registrar and his own expense, the ProBe course in ethics, within four months of the date of this order, requiring that Mr. Agivaev respond to all College communication within fifteen (15) days of delivery (deemed or otherwise); and requiring that Mr. Agivaev advise the College of any changes to any contact information within fifteen days of the date of change. 4.
