REASONS FOR DECISION
This matter was placed before a three (3) member Panel of the Discpline Committee of the COllege of Denturists of Ontario for hearing on April 3rd, 2007.
This matter was previously before the Committee on January 19th, 2007. The Discipline Committee agreed to adjourn the matter at the Member’s request to April 3rd, 2007 on a preemptory basis.
The matter proceeded on April 3rd, 2007 before this Committee with Mr. Sweet representing himself.
After hearing the evidence, we found that the Member had committed professional misconduct in several aspects as follows:
1. The Member held himself out as a Denturist while under suspension.
2. The Member did not respond to the College over the course of a four month period while under suspension.
3. The Member failed to pay amounts owing to the College of Denturists of Ontario in the sum of $5,000.
4. The Member failed to complete any courses in ethics or record keeping, as required.
We found a number of areas of deficiency in the record keeping and billing practices of the Member. Services claimed were different or not performed as was documented. The Member failed to maintain the minimum standards of practice in respect of record keeping. He altered records without stating that entries were added to those records later in time. Follow up procedures for denture work that was incomplete were not performed.
The Member did serve a four month suspension but, in course of that suspension, did not fulfill his obligation in advising the Registrar of the courses that he had attended and paid no costs owing to the College.
Despite the fact that the Member’s certificate of registration was suspended as of April 24th, 2006 and ended on August 24th, 2006 it was not until October 17th, 2006 that the Member notified the College that there were no courses on ethics and record keeping in Sudbury.
The Member worked on Ms. JB’s dentures while the Member was under suspension.
In all the circumstances, we find it appropriate the certificate of registration of the Member be revoked effective April 3rd, 2007. Mr. Mitchel Sweet is not permitted to hold himself as or advertise as being qualified to practice denturism in Ontario as a result.
