Allegation

It is alleged that the Member engaged in professional misconduct pursuant to s. 51(1)(c) of the Health Professions Procedural Code, which is Schedule II to the Regulated Health Professions Act, as set out in one or more of the following paragraphs of section 1 of Ontario Regulation 854/93: a. Failing to maintain the standards of practice of the profession (paragraph 2); and/or b. Discontinuing denturist services to a patient without adequate reason unless, i. the member has entered into an agreement to provide denturist services and the period specified in the agreement has expired, or the member has given the patient five working days’ notice of the member’s intention to discontinue the services agreed upon, ii. the services are no longer required, iii. the patient requests the discontinuation, iv. the patient has had a reasonable opportunity to arrange for the services of another member, or v. alternative services are arranged (paragraph 6); and/or denturism, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, unethical or unprofessional (paragraph 47).

Decision and Reasons

The panel accepted the Joint Submission as to Penalty and Costs and made an order: 1. Requiring the Member to appear before the panel to be reprimanded immediately following the hearing of this matter. 2. Directing the Registrar to suspend the Member’s Certificate of Registration for a period of four (4) weeks, on a schedule set by the Registrar. The Registrar will remit two (2) weeks of the suspension ordered if the Member successfully completes, to the Registrar’s satisfaction, the specified terms, conditions and limitations set out in paragraph 3 below within three months of the date of this order. In any event, the Member must complete the requirements set out in paragraph 3 of this order within six months of the date of this order. 3. Directing the Registrar to impose the following specified terms, conditions and limitations on the Member’s certificate of registration: a. The Member shall successfully complete, to the Registrar’s satisfaction, an ethics and professionalism course(s), pre-approved by the Registrar, at the Member’s expense. b. The Member shall write an essay acceptable to the Registrar, between 250-500 words in length, and provide it to the Registrar on the following issues: i. The proper process for discontinuing services to a patient; and ii. The lessons he learned during the ethics and professionalism course(s) and how his behaviour with the Client was unethical and unprofessional. 4. The Member shall pay the College’s costs fixed in the amount of $2,500.00 according to the following schedule: a. The Member shall deliver $1,500.00 to the College within one week of the date of the order of the Discipline Committee; and b. The Member shall deliver the remaining $1,000 to the College within three months of the date of the order of the Discipline Committee.

Specified Continuing Education or Remediation Program (SCERPs)

As a result of its investigation of a complaint, the Inquiries, Complaints and Reports Committee required Mr. Lima to complete a Specified Continuing Education Remediation Program

Summary of the SCERP:
The SCERP is to be comprised of the following components: 1. within three (3) months of the date of this decision Mr. Lima shall complete the following clinical work (“Mentorship”) under the supervision of a College-approved mentor (“Mentor”): a. fabrication and fitting of four (4) partial dentures (1 of each classification including Kennedy class I, II, II, & IV) b. The Mentor shall observe and provide advice to Mr. Lima at each of the following steps of the denture fabrication and fitting process: i. design ii. impressions iii. border molding iv. custom trays v. final impressions vi. insertion c. The Mentor shall check the dentures at the time of insertion and confirm that the dentures are properly fabricated and fitted. d. The Mentor shall provide help and advice to Mr. Lima as needed throughout the cases. 2. Mr. Lima shall provide a written reflection of 1-2 pages in length to the Registrar of the College which describes what he learned from the Mentorship and how he has changed or improved his clinical skills as a result of the Mentorship. 3. The Mentor will provide the Registrar with a report after the Mentorship is complete. The report shall include comments on Mr. Lima’s clinical skills and changes or improvements to those skills throughout the Mentorship. 4. All costs associated with the SCERP (including payment to the Mentor for their time) shall be borne by Mr. Lima.

Ms. Mietkiewitz shall receive a copy of this decision and of Mr. Lima’s prior history before the ICRC in order for her to gain an understanding of the issues and areas in which Mr. Lima requires remedial assistance. ii. Within thirty (30) days of the meeting, Ms. Mietkiewitz shall send a report to the Registrar confirming Mr. Lima’s attendance and confirming that Mr. Lima understands the issues with his professional behaviour as outlined in this decision and as reflected by the patterns in his prior history with the College. c. within three (3) months of the date of this decision Mr. Lima shall provide a written reflection of 1-2 pages in length to the Registrar of the College which describes what he learned from the Mentorship and from his meeting with Ms. Mietkiewitz and how he has changed or improved his clinical skills as a result of these learning opportunities. d. All costs associated with the SCERP (including payment to the Mentor and to Ms. Mietkiewitz) shall be borne by Mr. Lima.
