Decision and ReasonsOn November 22, 2016, a Panel of the Discipline Committee found that Mr. Vrljic engaged in the following acts of professional misconduct: 1. He has been found guilty of a criminal offence that is relevant to the member’s suitability to practise. 2. He sexually abused a patient, specifically touching of the patient in a sexual nature by Mr. Vrljic, including, but not limited to, masturbation by Mr. Vrljic in the presence of the patient and behaviour and remarks of a sexual nature towards the patient). 3. He failed to maintain the standards of practice of the profession. 4. He abused a patient verbally or physically. 5. He engaged in conduct or performed an act, relevant to the practice of denturism, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, unethical or unprofessional.
Order: The Panel of the Discipline Committee ordered the following sanction: 1. The Registrar is directed to revoke Mr.Vrljic’s certificate of registration effective November 22, 2016. 2. Mr. Vrljic is required to appear before the Discipline Panel to be reprimanded. 3. Mr. Vrljic is required to reimburse the College for funding provided for the patient under the program required under s. 85.7 of the Health Professions Procedural Code 4. Mr. Vrljic is required to pay to the College costs in the amount of $7 000.00.

Summary:
On March 31, 2016 DV was found guilty of the following offences:
1. Sexual assault (s. 271 of the Criminal Code of Canada)
2. Forcible confinement (s. 279(2) of the Criminal Code of Canada)
DV did not attend the trial and was sentenced in absentia. The sentence was as follows:
1. Sexual assault – nine month imprisonment, three year adult probation order, ten year registration under the Sex Offender Information Registration Act, five year weapon prohibition and order to provide a sample of his DNA
2. Forcible confinement - nine month imprisonment, three year adult probation order, ten year registration under the Sex Offender Information Registration Act, five year weapon prohibition and order to provide a sample of his DNA (note that the two sentences ran concurrently)
